Welcome to LAMA_FERA™! The terms "we", "us" and "our" refer to TRUEBAL FOUNDATION operating under the trade name LAMA-FERA. We operate the website https://lama-fera.com and provide you with a curated online shopping experience for essential oil products (the "Services").
These Terms of Service ("Terms") describe your rights and responsibilities when using our Services and are governed by the laws of India, including the Consumer Protection Act, 2019, the Information Technology Act, 2000, and other applicable Indian regulations.
Please read these Terms carefully before placing any order. By accessing or using our website, you agree to be bound by these Terms.
SECTION 1 — ELIGIBILITY AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least 18 years of age or the age of majority in your jurisdiction. If you are a minor, you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when registering or placing an order.
You may not transfer, sell, or assign your account to any other person.
SECTION 2 — OUR PRODUCTS
LAMA_FERA™ essential oils are natural aromatherapy products intended for external use only. They are not medicines, drugs, or medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
We have made every effort to accurately represent our products. However, product appearance may vary slightly due to screen settings, device configurations, or batch variations. Product descriptions are subject to change at any time.
We reserve the right to discontinue any product or limit quantities available to any person, geographic region, or jurisdiction at our sole discretion.
Individual results from aromatherapy use may vary. Any benefits described are based on the aromatic properties of the ingredients and not medical claims.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. TRUEBAL FOUNDATION (LAMA-FERA) reserves the right to accept or decline your order for any reason. Your order is confirmed only after we send you an order confirmation via email or WhatsApp.
We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as cancellations after order acceptance may not always be possible.
In the event we decline, modify, or cancel an order, we will notify you using the contact details provided at the time of purchase.
Your purchases are subject to our Return and Refund Policy, which forms part of these Terms.
SECTION 4 — PRICES, TAXES AND BILLING
All prices are listed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. Shipping charges, if any, will be displayed at checkout before you confirm your order.
Prices are subject to change without notice. The price charged will be the price confirmed in your order confirmation email at the time of purchase.
We accept the following payment methods through our secure payment gateway (Razorpay):

• Digital Wallets
• Cash on Delivery (COD) — available for eligible locations
All transactions are encrypted and processed securely. We do not store any sensitive payment information, including card details, CVV, or banking credentials.

SECTION 5 — SHIPPING AND DELIVERY
We currently ship across India only. International shipping is not available at this time.
Orders are processed within 1–2 business days. Standard delivery typically takes 5–7 business days after dispatch. All delivery timelines are estimates and are not guaranteed.
Free shipping is available on all prepaid orders. A nominal COD handling fee may apply for Cash on Delivery orders.
We are not liable for delays caused by courier partners, weather conditions, public holidays, remote locations, or incorrect/incomplete addresses provided by the customer.
Once your order is dispatched, you will receive a tracking number via email. Risk of loss passes to you upon delivery to the carrier.
SECTION 6 — RETURNS, REFUNDS AND CANCELLATIONS

Key summary:
• Returns accepted only for damaged, defective, or incorrectly delivered items.
• Return requests must be made within 7 days of delivery with photographic/video proof.
• Products with broken seals or that have been used are not eligible for return.
• Refunds are processed to the original payment method within 10 business days of return approval.
• A 4% restocking fee applies to discretionary returns of sealed, undamaged products.
• Order cancellations are accepted within 7 days of placing the order.
In accordance with the Consumer Protection Act, 2019 (India), we are committed to resolving all genuine customer grievances fairly and promptly.
SECTION 7 — CONSUMER RIGHTS — INDIAN LAW
As a consumer in India, you are protected under the Consumer Protection Act, 2019. Your rights include the right to be informed, the right to choose, and the right to seek redressal for defective products or deficient services.

All content on the Services, including trademarks, brand name, text, images, graphics, product descriptions, video, and audio, is owned by TRUEBAL FOUNDATION (LAMA_FERA™) or its licensors and is protected under Indian intellectual property laws including the Trade Marks Act, 1999 and the Copyright Act, 1957.
You may use the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, or commercially exploit any content from our website without our prior written consent.
SECTION 9 — THIRD-PARTY LINKS AND TOOLS
Our website may contain links to third-party websites or tools (including Razorpay, Shiprocket, and Shopify). We are not responsible for the content, accuracy, or practices of these third-party platforms.

Purchases made on our website are made directly with TRUEBAL FOUNDATION (LAMA-FERA). Shopify is our e-commerce platform provider and is not responsible for any aspect of your transactions with us.

We collect and process personal information in accordance with our Privacy Policy, available at https://lama-fera.com/policies/privacy-policy, and in compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

SECTION 11 — USER FEEDBACK AND REVIEWS
If you submit feedback, reviews, or suggestions, you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content for the purpose of operating and improving our Services.
You represent that your feedback is genuine, accurate, and your own. You must not submit false, misleading, or incentivized reviews. We reserve the right to remove feedback that is unlawful, offensive, or in violation of these Terms.

LAMA_FERA™ essential oils are provided "as is" for aromatherapy use. We do not make any medical claims. We make no warranty that the Services will be uninterrupted, error-free, or completely secure.
To the extent permitted under Indian law, we disclaim all implied warranties of merchantability or fitness for a particular purpose. Nothing in these Terms limits your statutory rights as a consumer under Indian law.
SECTION 15 — LIMITATION OF LIABILITY
To the fullest extent permitted by Indian law, TRUEBAL FOUNDATION shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the Services or products.
Our total liability to you for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid for the specific product giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under Indian law.
SECTION 16 — INDEMNIFICATION
You agree to indemnify and hold harmless TRUEBAL FOUNDATION, its officers, employees, and agents from any claims, damages, losses, or costs (including reasonable legal fees) arising from your breach of these Terms, your violation of any applicable law, or your use of the Services.
SECTION 17 — GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Farrukhabad, Uttar Pradesh, India.
We encourage you to contact us first to resolve any dispute amicably. For consumer disputes, you may also approach the Consumer Disputes Redressal Commission as outlined in Section 7.
SECTION 18 — SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable under applicable Indian law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
SECTION 19 — CHANGES TO TERMS OF SERVICE
We reserve the right to update or modify these Terms at any time. Material changes will be communicated to you via email or a prominent notice on our website at least 7 days before they take effect, in accordance with applicable law.
